These Terms of Service ("Terms") govern your use of Thoughts Count, a product of Damay Enterprises ("we," "us," or "our"), available at thoughtscount.com. By using Thoughts Count, you agree to these Terms. If you don't agree, please don't use the service.
Thoughts Count helps you show up for the people and moments that matter. Through a short conversation, it offers a personalized plan — things you might say, things to avoid, thoughtful gestures, and ideas — and, if you choose, gentle reminders. Our goal is to help good intentions become meaningful actions.
Thoughts Count uses passwordless, email "magic link" sign-in. You're responsible for keeping access to your email secure, and for the activity that happens under your account. You must be at least 13 years old (and old enough to form a binding agreement where you live) to use the service.

The details you share to build your plan remain yours. You grant us permission to process that information solely to provide the service to you (create your plan, save your people and dates, and send reminders you request), as described in our Privacy Policy.
Thoughts Count, including its guides, content, design, and software, is owned by Damay Enterprises and protected by intellectual-property laws. You may use it for your personal, non-commercial purposes; you may not copy, resell, or redistribute it without our permission.
Thoughts Count is provided "as is" and "as available," without warranties of any kind. We don't guarantee that its suggestions will be right for every situation, that reminders will always be delivered on time, or that the service will be uninterrupted or error-free. You use the suggestions at your own discretion.
To the fullest extent permitted by law, Damay Enterprises will not be liable for any indirect, incidental, special, or consequential damages arising from your use of Thoughts Count. Our total liability for any claim relating to the service will not exceed the amount you paid us, if any, for the service in the prior twelve months.
We may update, change, or discontinue parts of Thoughts Count, and we may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above. Your continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the United States and the state in which Damay Enterprises is organized, without regard to conflict-of-laws rules.
